There are many obvious reasons to wear a helmet when cycling yet many people still don’t. If you choose not to, and suffer an injury, you could find a personal injury claim weakened by a Contributory Negligence defence.
Put simply, you contributed to your own injuries by not using reasonable precautions, even if the accident was someone else’s fault.
But it isn’t just missing helmets. Not wearing a high-visibility jacket during an accident at night has seen the Contributory Negligence argument used against another cyclist’s personal injury claim. It was also successfully used against an injured cyclist, who was deemed to have contributed to their own injuries because of reckless cycling.
So, when you next go out on your bike, do check that you are doing everything you can to ensure your safety: that means wearing your helmet, checking your lights are working, putting on your high-vis reflective clothing and ensuring that your tires and brakes are in good health.
