Asbestos & Mesothelioma Claims

The importation of asbestos into the UK has since the 1960s reduced dramatically to virtually nothing today due to the increasing awareness of its risks to health.

Even so the number of deaths each year due to mesothelioma has increased year on year and continues to do so. This is due to the very long latency period between exposure to asbestos dust and diagnosis of the disease, typically 30 years but very often 40 or 50 years and sometimes longer.

Workers who have been exposed to asbestos dust are often therefore not affected until their retirement years. The same is true of victims of secondary exposure, such as relatives who have been exposed due to washing and handling their contaminated overalls.

A diagnosis of mesothelioma or any other asbestos related disease, asbestosis, lung cancer and pleural thickening is devastating news to the victim and their family. Our solicitors are highly experienced in dealing with such claims and will deal with your claim with compassion.

The courts appreciate the importance of dealing with mesothelioma claims promptly and our solicitors have where necessary been able to obtain trial dates within just four months of the issue of proceedings even where there has been more than one defendant.

Our solicitors will as quickly as possible investigate the nature and extent of exposure, the state of knowledge at the time of exposure and identify any culpable employers and their insurers.

Even where an employer no longer exists it is still possible to bring a claim if their insurers can be identified. Even if the insurer cannot be identified it may still be possible to make a claim against fund to be set up by the government if the diagnosis of mesothelioma was after 25 July 2012. A Bill in this regard is currently going through Parliament

We will instruct a respiratory physician as an expert witness and possibly also an engineer.

Our solicitors have acted not only for workers exposed to asbestos dust but also their relatives who have suffered from secondary exposure. They will sensitively guide you through the process and of the claim advising you on the likelihood of success, the values of the claim and where possible obtain interim payments.

A significant amount of work will be undertaken on your behalf and therefore it is very important that you seek immediate legal advice.
